The mission of the Texas Board of Chiropractic Examiners is to execute the statutory authority of the Texas Chiropractic Act (Texas Occupations Code, Chapter 201) and to promote, preserve, and protect the health, safety, and welfare of the people of Texas by licensing skilled professionals and enforcing standards of practice.
The office of the TBCE will be closed Monday, February 20th in observance of Presidents' Day. The office will resume normal operating hours Tuesday, February 21st from 8:00 a.m. to 5:00 p.m. CST.
Advertising, Scope and Proper Use of Credentials
The role of the Texas Board of Chiropractic Examiners (TBCE) is to enforce the chiropractic statute and rules and to protect the public. One area where we see potential violations and risk of misleading the public is in website and other advertising. Specific issues are advertising treatment that is outside the scope of practice or misleading, and improper use of credentialing.

Governor Appoints Dr. Michael P. Henry To The TBCE Board To Expire February 1, 2019
Governor Greg Abbott has appointed Dr. Michael P. Henry to the Texas Board of Chiropractic Examiners for a term set to expire on February 1, 2019. The board is responsible for regulating the practice of chiropractic.
Michael P. Henry, D.C. of Austin is a doctor of chiropractic and the clinic director of TexStar Chiropractic Clinic. He is a member of the Texas Chiropractic Association, American Chiropractic Association and the Austin chapter of Ducks Unlimited. He is a former volunteer for the North Texas Make-A-Wish Foundation, Boy Scouts of America and Young Men’s Business League. Henry received a Bachelor of Science in kinesiology from The University of Texas at Austin and a Doctor of Chiropractic from Parker University.
TBCE Update On Litigation, Cause No. D-1-GN-11-000326, And Appeal
The Texas Board of Chiropractic Examiners (TBCE) has received many questions from our licensees regarding the recent judgment by Travis County District Court Judge Rhonda Hurley, officially issued October 19, 2016. The matter concerns provisions of 22 TEX. ADMIN. CODE §78.13, Chiropractic Scope of Practice, which the Texas Medical Association has challenged as exceeding the scope of practice, defined by the Legislature in TEX. OCC.CODE §201.002 (b). Look for a message to the email address you have provided to the TBCE, for further information.
The TBCE met at its quarterly board meeting, November 17, 2016, and voted to move forward with an appeal. Pursuant to the appeals process, the appeal will be filed on or before January 17, 2017. The legal matter is not final until all appeals have been exhausted and a ruling is rendered by a higher court. In the meantime, the TBCE rules and regulations continue to govern the practice of chiropractic and licensees can continue to practice as they have pursuant to the scope of practice, codified in 22 TEX. ADMIN. CODE §78.13, which includes diagnosis.

Application Of Funds Received To Be Applied To Past Administrative Fines: Rule 78.6(b)
Effective September 1, 2016, any monetary funds received by the Board will be applied to any outstanding balances owed by that person prior to renewing a license or a facility registration. Rule 78.6(b)

Courtney Ebeier Joins TBCE As General Counsel
Courtney is a Texas native with 14 collective years living and working in Austin, Texas. She is a graduate of the University of Texas of Austin, College of Communications, where she earned a bachelor of journalism, and a J.D. graduate of South Texas College of Law of Houston. She is an experienced consumer and commercial law litigator with expertise in providing regulatory compliance counsel in connection with commercial business and consumer protection laws. Her litigation background includes title insurance defense, transactional real estate and consumer mortgage lending and servicing defense of matters. She has litigated in all venues of Texas, from county, state to federal, including appellate practice in the First and Fourteenth Courts of Appeals.
Courtney returned to Austin in 2015 to serve as associate general counsel for a national real-estate and mortgage lending company where she assisted and advised in regulatory compliance and vendor management. There she created and implemented a compliance management and vendor management system, consumer complaint process, and advised executive management on regulatory compliance matters pursuant to state regulations and federal consumer protection laws promulgated by the Consumer Financial Protection Bureau.
